Terms of Use

The following Terms of Use ("Agreement") describe the terms and conditions ("Terms") which apply to use of the services provided by Jacob Marketing, Inc. dba BrideScan ("BrideScan" or "We"), as was made available at www.BrideScan.com and via the Google Play store and Apple App Store. By using the website or downloading the app onto a mobile device, the user ("you") signifies acceptance of these Terms. If you do not agree to these Terms in any part, we request that you not participate in any way via the website or mobile app. Please note that we reserve the right to amend these Terms at any time, without prior notice. Any modifications or changes we make will take full effect immediately upon update to this page. Please visit this page periodically to review current updates or changes, as any updates or modifications bind you. Note that this Agreement can not be modified, amended, and/or changed in any way except by BrideScan.
Notice 1: BrideScan claims no responsibility for interactions between account holders.
We offer the ability for users of all stages to use these services without bias on a voluntary basis. As such, we do not claim to be a wedding service or product, nor are we a wedding vendor or appointed agent. BrideScan account holders include brides and grooms ("Members"), bridal show producers ("Producer Members"), and wedding companies and third parties offering wedding-related goods or services ("Vendor Members"). BrideScan is in no way involved in purchases, transactions, or agreements of any kind between members. We have no control over, and claim no responsibility for, issues that may arise before, during, or after events created by Producer Members. We have no control over listing accuracy of Producer Members or Vendor Members. We are not responsible for any action or failure to execute actions of Members, Producer Members, or Vendor Members.
Members: You acknowledge the following: BrideScan provides a service allowing you to share your contact information, and by using BrideScan, you give permission for BrideScan or those you scan, to phone, email or text you. BrideScan does not provide any wedding service or product offered by Vendor Members. We do not endorse, nor do we guarantee the quality of, Vendor Members, goods or services. Any agreements or offers made through the BrideScan venue are not backed by us and are made solely between you and the Vendor Member. Disputes which may arise from these goods, services, or interactions are solely between you and the Vendor Member. BrideScan will not be a party to said disputes except with regard to user participation of BrideScan. You take full responsibility for vouching and researching each good or service prior to entering an agreement.
Vendor Members: You acknowledge the following: BrideScan does not endorse your goods or services, nor do we assist in agreements between you and Members, or in providing goods and services you claim to provide. We do not endorse, nor do we guarantee the quality of, Members, provided information. Any agreements or offers made through the BrideScan venue are not backed by us and are made solely between you and the Member. Disputes which may arise from these goods, services, or interactions are solely between you and the Member. BrideScan will not be a party to said disputes except with regard to user participation of BrideScan. You take full responsibility for any agreements made via BrideScan.
Producer Members: You acknowledge the following: BrideScan does not endorse your events or marketing materials, nor do we assist in agreements between you and Vendor Members or Members, or in providing goods and services you claim to provide. We do not endorse, nor do we guarantee the quality of, any user or user information participating in your events. Any agreements or offers made through the BrideScan venue are not backed by us and are made solely between you and the Vendor Member or Member. Disputes which may arise from these goods, services, or interactions are solely between you and the Vendor Member or Member. BrideScan will not be a party to said disputes except with regard to user participation of BrideScan. You take full responsibility for any agreements made via BrideScan.
Notice 2: Membership for Account Holders is conditional.
Membership to BrideScan is available only with the following parameters:
- Account holders must be at least 18 years old and legally capable of entering binding contracts under applicable law
- Account holders registering as a business or show producer implicitly acknowledge that they have proof of a business license and the right to bind said business to this Agreement
- Account holders must at all times provide us with accurate, truthful, and regularly updated information; must abide by all Terms of Use, and must protect usernames and passwords
- Account holders acknowledge that they are solely responsible for all activity within BrideScan
Notice 3: The following Prohibited Activities are hereby stated.
You may not:
- Create account(s) in another's name
- Create more than one account for the same entity
- Use another's account
- Impersonate another entity
- vSell or share account holder information with an outside entity for business gain
- Extend your membership benefits to an entity not within the BrideScan venue
- Offer to provide products or services that violate any applicable law
- Use information to send unsolicited email
- Violate any terms of this Agreement
Notice 4: Protection of Intellectual Property Content.
The BrideScan Site contains or uses potentially patentable business method material, design logos, phrases, names, logos, HTML code and/or other computer code and/or scripts (collectively, "Intellectual Property Content"), all of which, unless otherwise indicated and/or provided pursuant to a third party license, are our sole property, and We retain all rights, interests and title thereto.
Notice 5: DMCA Notice procedures.
Reporting
We take claims of copyright infringement seriously. We will respond to notices of alleged copyright
infringement that comply with applicable law. If you believe any materials accessible via BrideScan
infringe your copyright, you may request removal of those materials by sending written notification
(in full accordance with the Online Copyright Infringement Liability Limitation Act of the Digital
Millennium Copyright Act - DCMA) to:

Misrepresentation
Note that if you knowingly misrepresent that material or activity via BrideScan infringes upon your
copyright, you may be held liable for damages (including costs and attorneys' fees) under Section
512(f) of the DMCA.
Notice 6: Fraudulent activity will not be tolerated.
BrideScan may terminate your account if we suspect that you have engaged in fraudulent activity within the venue, as determined in our sole discretion.

Notice 8: Right to Reject or Remove Members.
We reserve the right to reject your participation, or remove you from your current participation, in the BrideScan venue at any time and for any reason or for no reason and without notice to you
Notice 9: BrideScan use comes without any promise of warranty.
All services are provided on an as-is basis, without any warranty or guarantee of any kind. Your use of the application and site is voluntary. Neither BrideScan nor members of Jacob Marketing, Inc., nor subcontracting parties may be held liable for any issues that may arise. BrideScan also does not guarantee or warrant that information you provide or download within the venue are free from error, corruptness, or other harmful components, nor do we guarantee or warrant that such information is secure.
Notice 10: BrideScan claims no liability for issues that arise from application or site use.
Neither BrideScan nor members of Jacob Marketing, Inc., nor subcontracting parties may be held liable for any issues that may arise from signing up or using the BrideScan application or site. We are not liable to you for any direct or indirect damages, lost profits, or damages of any kind arising from your voluntary use of the application or site.
Notice 11: Indemnity.
You agree to indemnify and hold us harmless for any claim made against you by any third party due to or arising in any way by your use of the application or site.
Notice 12: Links to External Sites
External sites may be linked within the BrideScan application or site. These are provided for your convenience. We do not vouch for the safety or availability of said sites. You agree that by clicking to an external site via BrideScan, you are bound by that site,s specific Privacy Policy and Terms of Use. We are not responsible for content or usability of applications or sites outside the BrideScan venue.
Notice 13: Governing Law; Venue and Jurisdiction
By using BrideScan, you agree that the laws of the State of Tennessee, without regard to principles of conflict of laws of any state or jurisdiction, will govern these Terms and any dispute of any sort that might arise between you and BrideScan or any of our affiliates. You agree not to commence or prosecute any action other than in the state and federal courts of Tennessee, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of Tennessee.
